Grounds For Filing For Divorce in South Carolina

South Carolina offers four grounds for divorce. Three are fault grounds, including:

  • Adultery
  • Habitual drunkenness
  • Physical cruelty

Few people pursue divorce in South Carolina using a fault ground. Most choose the fourth ground, the no-fault ground, which is to live apart for 12 months.

Living apart for 12 months prior to filing for divorce is not a convenient option for many people, but it avoids the difficulty and embarrassment of proving a fault ground.

If you choose to obtain a divorce on living apart for 12 months, we can help you can file for separate support and maintenance. This would address things like custody, visitation, division of assets and debts, child support and alimony from the time you file until you can obtain your divorce. Learn more by clicking here.

Does Fault Make a Difference in Divorce?

Fault can make a difference in alimony. A spouse who commits adultery is not entitled to alimony in South Carolina. However, an award of alimony is not typical in South Carolina divorces, regardless of fault. As a rule, alimony may be awarded to the spouse with lower income (the man or the woman) in long-term marriages, which is generally a marriage that lasts 10 years or longer.
